And, thinking about Liberation Day, and, you know, I I knew that that the president was going to make a a formal announcement at the Rose Garden in the afternoon, and I was really hoping, really, really hoping that he was gonna just lay it out as crystal clear as you can possibly lay it out, so that people can really understand it. And and not have to rely on the mainstream media, the legacy media, to to to try to spin it as a negative thing.
And one of the things that we're gonna see when we get into the into the into the pieces that we're gonna look at today is, he used a word repeatedly, and that word is reciprocal. So, while we go through the usual business of opening up the show, if you wanna go look up what the word reciprocal means, especially if you're a liberal, you might not understand what that word means. You'll see what we're talking about, and it'll help you to understand when I play the clips for you of what the president was outlining and, laid out, and, and all the great interesting things that took place throughout, the day.

And, so we're gonna be probably spending a lot of time there, and we're also gonna be spending some some time, talking about, all of this, these these judicial activists that have been, you know, slapping these nationwide injunctions on the administration.

Well, president Trump's aggressive made in America policies and his commitment to bringing industry back to American soil. This is exactly what Trump promised. America First is back.

As Donald Trump posted on his truth social today, it's Liberation Day in America. So that's that is great news. Now, US Secretary Of Commerce, Howard Lutnick, explained during a cabinet meeting last month that, Liberation Day would mark a turning point for this country, where America would would again be respected.

What is so exciting is April 2 is just around the corner, and that's American Liberation Day. That's the day when the rest of the world starts to treat America with respect and your leadership understanding how the rest of the world treats us and what balance and what fair trade finally is gonna be. It's gonna take care of America. It's gonna launch the external revenue service to start to build the power and prestige of America back, and I'm honored to be helping you, on that course.

So the Trump administration titled, April 2 as Liberation Day, And it is the day that the administration starts, the reciprocal tariffs. Basically, what he's doing is he's he's forcing other countries that took advantage of The United States One sec. Let me just fix that really quick. Here we go. So of of other countries that took that has taken advantage of The United States for years, years, and years, basically ripping us off. In, in a USA Today op ed, Peter Navarro, who is who's, Trump's, senior senior counsel for trade and manufacturing, said that, tariffs on the auto industry alone would create jobs and increase wages, and he argued that that, it is critical to to national security for The United States to manufacture critical component components like powertrain systems.
He said, quote, powertrain assembly demands deep experience in skilled labor, which is why wages in powertrain facilities are 10 to 20% higher than those in final assembly plants. Today, this, this key pillar of America's once vaunted arsenal of democracy has been hollowed out by decades of unfair trade. No longer does America fully manufacture its its own automobiles. And then here's the here's the gut punch. Fewer than 20% of the engines for vehicles it's, America produces, where where did I get that? America produces fewer than 20% of the engines for the vehicles it it sells. Germany and Japan actually, produce a much a much larger share of the engines and transmissions, that that, that are driving along American roads.
By extending tariffs to this is a quote. By extending tariffs to both autos and auto parts, president Trump is confronting this threat to America's economic and national security. He understands that powertrain design and production are not just technical challenges, they are strategic capabilities. Lose them, and we don't just lose good jobs, we lose industrial strength needed for national defense. And, the markets really did actually reflect. Today, the Dow Jones was up at, as of, this morning. Dow Jones was up, 0.80% at, for an overall of, plus three three seven point eighteen.
The S and P was up 55. The, the, the Nasdaq was up two thirty nine. Russell was up, 29.28. So all of this all of this is having already a positive effect on the American economy, and that's key. That is absolutely key. Like Donald Trump said, it is Liberation Day in America. So at the Rose Garden, the president had a, had a, a presentation, and, he announced his, his his whole display. He he put out the whole display of all of these new tariffs, and, this is, this is where we are, right here. It's gonna be a three minute clip, so I want you to hear this whole thing.
Or maybe not a three minute clip because it's not playing, at least on my end. Will we restart it? Alright. I guess not. Alright. Let's go to, let's go to number two. Let's see if number two works at least.

Frankly, it's, very upsetting when you read it, when you see what people have been doing to us for thirty years. This all happened with no response from The United States Of America, none whatsoever. But those days are over. Let me offer just a few examples of the vicious attacks our workers have faced for so many years. The United States charges other countries only a 2.4 tariff on motorcycles. Meanwhile, Thai Thailand and others are charging much higher prices like 60%, India charges 70%, Vietnam charges 75%, and others are even higher than that.
Likewise, until today, The United States has for decades charged a 2.5 tariff. Think of that, 2.5% on foreign made automobiles. The European Union charges us more than 10% tariffs and they have 20% VATs, much much higher. India charges 70% and perhaps worst of all are the non monetary restrictions imposed by South Korea, Japan and very many other nations. As a result of these colossal trade barriers, 81% of the cars in South Korea are made in South Korea. Ninety Four Percent of the cars in Japan are made in Japan. Toyota sells 1,000,000 foreign made automobiles into The United States and General Motors sells almost none.
Ford sells very little. None of our companies are allowed to go into other countries, and I say that friend and foe. And in many cases, the friend is worse than the foe in terms of trade. But such horrendous imbalances have devastated our industrial base and put our national security at risk. I don't blame these other countries at all for this calamity. I blame former presidents and past leaders who weren't doing their job. They let it happen, and they let it happen to an extent that nobody can even believe. That's why effective at midnight, we will impose a 25% tariff on all foreign made automobiles.

So, he also brought out a chart, displaying the tariff rates that he planned to to put on on each nation. Alright. China, which tariffs US goods at a rate of 67%, will face tariffs of 34%. Countries in the European Union, which tariff US goods at a rate of 39% are gonna be tariffed at 20%. Vietnam, a 46% tariff. Taiwan, a 32% tariff. Japan, a 24%. India, twenty six %. And South Korea, a 25%. And and then the chart had like 20 more, countries, listed on there. And, what they also did is they there's like kindergarten, they handed out a fact sheet prior to the announcement that that basically showed, how the administration, was was approaching the tariffs and and and how the administration believes that the tariffs will balance the trade relationships, and and and actually and and bring manufacturing back to America, back on back to The United States on American soil.
Now of course, and that well, as also as you heard him mention in the clip here, you know, the 25% tariffs on automobiles that aren't made in The United States. But but if and you we're already seeing this with, with with Hyundai, with Honda, Nissan, that have committed to bringing manufacturing and production back to The United States, those power those tariffs won't apply. See, the whole idea is to get manufacturing back here into The United States, and, for those that are not going to do anything like that or, you know, it's it's it's applying these what we called reciprocal taxes. Now, I told you earlier to look up what reciprocal is. All that means is, if a country is charging us 10%, we're gonna charge them 10%.
If they charge us 50%, we're gonna charge them 50%. That's reciprocal tax, tariffs. Alright? It's not what the what the mainstream media and, the Democrats are making it out to be. Dollar store Obama, Hakeem Jeffries, of course, criticized the president's tariff plan. And, he told report he told he told, reporters on Wednesday, that, you know, House Republicans, Senate Republicans, and Donald Trump haven't done a single thing to lower the cost of living in the country. Not a single bill, not a single executive order, not a single administrative action. He said, in fact, Republicans are crashing the economy in real time and driving us into recession. This is not a liberation day. It's recession day. And that's what the Trump tariffs are gonna do, crash the economy, he added. But that's not the case at all.
Not the case at all. Just as a stupid example, because of course, you know, you know, egg prices. Everybody's talking about egg prices. Now do you remember, when when when Joe Biden was in office? Nobody seemed to care about the price of eggs in the Democratic side. Right? Nobody said a word about it. The minute that Donald Trump took office, it was, well he didn't bring down the price of eggs, you know, eggs are eggs are really expensive now, and so on and so forth. Eggs, the price of eggs have dramatically dropped. And I forget the percentage. I I know I have it in here somewhere. I'll I'll I'll pull it up for you, but the average price of eggs has decreased.
Gas has decreased. Gas is now, on average below $3 a gallon. That's because we've unleashed American energy. We've unleashed we've opened up to more drilling. We've opened up to more, exploration. We've we've done step by step by step the administration has taken to bring the economy back, to bring the prices down, to bring the cost of living down. And it's not something that's gonna that you you're gonna pick up overnight. It's going to be something that you're gonna it's gonna take time, and we're on the right track. And these tariffs, again, reciprocal tariffs.
What they're charging us, we're charging them. I don't think that that's a that I don't think that's unreasonable. Now just to just to to bring up a point here, in 02/2024, a study was done, that found that that, the tariffs that that the Trump administration put on in his first term strengthened The US economy and led to significant restoring of industries like manufacturing and steel production. And, you know, again, second term, not even a hundred days into the second term, and he's already brought in $5,000,000,000,000 in investments into The US economies by Oracle, SoftBank, Apple, Nvidia, just to name a few of them. So this is this is great news. This is great stuff that's gonna be coming down the road for for America, and I am I'm excited about it, and you should be too. And you should be too. And don't think that that that these other countries, these these other these foreign countries that that have been stopping their feet, and crying and complaining about, about the tariffs, and how they're gonna, you know, increase tariffs on on us, and so on. They're already falling in line. Already falling in line.
For example, Israel. Yesterday, prior to Liberation Day, so a whole day ahead of Liberation Day, Israel announced that it would end all tariffs or customs duties on US imports. The day before, In a joint statement by the prime minister's office, finance ministry, and, and economy and industry ministry said this, quote, at the directive of prime minister Benjamin Netanyahu, finance minister, Bezalel Smotrich, and economy and industry minister Nir Barkat. Israel has canceled all of the customs duties that have been levied until now on products up from The United States, Israel's largest largest trading partner.
The US is Israel's closest ally and most significant trading partner. In 2,024, the export of goods to The US stood at 17,300,000,000.0, while the export of services was estimated at 16,700,000,000.0. The reduction in custom duties will, in effect, expand The US Israel trade agreement and strengthen bilateral strategic relations. The reduction also entails an insurance to Israel Israeli consumers in the form of possible reduction in the cost of living within the anticipated expansion of import and imports of food and agricultural products from The US, which will benefit from a zero customs rate.
So already, even before even before Liberation Day was official, you had Israel canceling all duties, customs, and tariffs on American goods. Mexico has also reduced tariffs already. And, of course, our neighbors up north what the administration likes to call the fifty first state. Also, backing down after the tariff threat came about. Ontario premier Doug Ford on Wednesday suggested that Canada would drop its tariffs on US goods if president Donald Trump eased up on his tariffs on Canadian goods. Let's take a look at, clip five.

The administration is taking the right steps. They're putting America First. They're putting the American worker first. They're putting the American people first. Now, of course the left is running around stomping their feet and you know, sucking their thumbs, holding their temper tantrums just like they normally do. So, that's what you're seeing with all of these, these these Tesla, the the vandalism of all these Tesla vehicles and and the, the destruction of Tesla charging stations, you know, it's it's just obstructionism. What they need is a good spanking, but probably get in trouble for saying something like that. Right? So, Tesla terrorists suddenly face more than just criminal charges. You know, the the attorney general's talking about, you know, domestic terrorism. That that they're talking about, you know, penalties up to twenty years in jail. You know, in in one recent incident that took place in, in Plano, out here in Texas, Cooper Joe Frederick, is it is, under suspicion for, attacking a Tesla dealership in in Loveland, Colorado.
And, the attorney general, Pam Bondi, you know, she she said this about the prosecution. She said, quote, let this be a warning. You can run, but you cannot hide. Justice is coming. She went on to say, she said, I made it clear that if you take part in the in the wave of domestic terrorism against Tesla properties, we will find you, arrest you, and put you behind bars. All of these cases are a serious threat to public safety, therefore, there will be no negotiation. Now, in addition to that, things are gonna get worse Because now this is taking place.
Fox News reported that, that that, the owner of one of those vandalized Teslas is now suing the suspect for a million dollars in damage. The suspect, Rafael Hernandez, was arrested just a week ago on criminal mischief charge by the Tarrant County District Attorney's Office after he was recorded by the Tesla built in camera striking the left side of the electric powered vehicle. Let's see. In the video, Hernandez could be seen pulling an object out of his pocket and forcing it into the side of the model of the model x. The lawsuit charges individual owners of Tesla vehicles, like like the plaintiff, are being targeted and victimized by ongoing criminal conduct and action.
And the, the report cited that the plaintiff's lawyer explained, whether you're a Republican or Democrat, this is a free country. You're entitled to drive whatever you want. As long as it's legal and within the confines of the law, you should feel safe and secure doing so. The lawyer pointed out the importance of consequences. He said it's a slippery slope. Where does it end?

Well, the victim is seeking $1,000,000, and we sat down with his attorney who tells me that he believes that this is the first civil lawsuit that has been filed, in connection to this Tesla takedown movement. His client who wants to stay anonymous, fearing that he is going to be targeted, was returning back from the, trip. He left his car at the Dallas Fort Worth Airport when he saw this. He realized his car had been keyed, so he checked the cameras. That's when he saw the man walk by and vandalize his car. So he posted on x. He wanted to find out who did this. That video quickly went viral. It even caught the attention of Donald Trump junior who posted the video and said, quote, Internet, do your thing. Well, according to the lawsuit, that video helped identify Rafael Hernandez who was arrested and charged with criminal mischief and since posted his bond. The victim's attorney told us, like so many of these victims here, his client just likes the car, and that's why he bought it, and he's apolitical.

That attorney that we sat down with who filed this lawsuit says he hopes this is going to send a really strong message. And, it's very interesting because as you know what's going on right now, you have these rogue activist judges that are issuing these nationwide injunctions.
And these aren't, you know, these are these are circuit court judges. These are district district court judges. And as I've said before, and I'll say it again, you know, a judge in in in in Rhode Island should not be able to issue an injunction that affects an issue that's going on anywhere else in the country other than in the in the district or the circuit that he is part of or she is part of. But we see that's that's what's happening. We're seeing all of these nationwide injunctions. We saw it with, this judge Boseberg putting an injunction on the administration for deportation of, of, of the Trendiagua, gang and MS thirteen gang members, to the the the prison in El Salvador, basically demanding that the plane turn around mid flight.
A circuit court judge shouldn't have the ability to do that, to impede the executive branch from doing its constitutionally authorized duties. Now, this subject came up today at a confirmation hearing for, again, Brett Shumate, who's going for, who's being, considered for the, an assistant attorney general. Alright. Now, this is this is kind of a long clip, but I really want you to hear it in its entirety. And I'm gonna I'm gonna I'm gonna wait until it's over, you know, to say anything about it because, first of all, with the the system that I use, I can't pause it. I would have to start all over again if I stop somewhere down the line into it. So, I'm gonna play the whole thing, it's about six minutes, but it's important.
It's very important, you need to hear this, and the line of questioning here. Because these judicial activists are doing everything they can at the behest of their donors, at the behest of the, the Democratic Party, doing everything they possibly can to impede the lawful functions of the executive branch. How can a judge, a federal judge, issue an order that affects everybody else other than those in front of him or her? How is that possible?

So so 27 injunctions in the twentieth century, 86 injunctions against Donald Trump in his first term, and already, not even eighty days into the second administration, 30. So the question is, should a district judge be able to control all of America? That's a it's that's the quest that's the question of the day. As a matter of fact, there was a, a podcast earlier today, hosted by let's see. It was, representatives Mary Miller, Diana Harshberger Barger, Marjorie Taylor Greene, Mark Alford, and they and they would and Mark Alford, they were discussing, you know, a, like, a slew of actions, on a docket for congressional Republicans, like rolling back the DEI stuff, and, dealing with judges.
Dealing with judges that use their misguided authority and trying to control everything that goes on in the country. That has to be the top priority of this Republican majority, which by the way is too larger now. Now there was a hearing held today on the hill. Daryl Issa, is actually chairing that that hearing. He's also, he's also leading the leading voice on on, on legislation to, to curtail the abuses of the judicial branch. And, he had a couple of high pretty high profile, folks testifying today on the Hill. And, some of the suggestions have been to defund, because that that is under the under the control of the Congress, you know. I mean, the Congress the the the the the circuit, the district courts are not a constitutionally appointed, serve, I I I'm trying to think of the right word.
They're they're not written into the constitution. Like, so in other words, they're they are created by the congress. Alright? And they and congress has oversight of this because congress controls the purse. So congress can and has in the past, which we're gonna hear in just a few moments, totally defund a judicial district. Shut it down completely. Wipe it out. And they can either not have one or they could start a new one. And if they start a new one with the Republican controlled house, they can very easily, of course, nominate and confirm judges that are more in line with the, the Republican party's, agenda.
So on the house today, you had Newt Gingrich, former speaker of the house, Newt Gingrich, questioned today by, representative Issa, and, this is what he had to say.

There is clearly a potential constitutional crisis involving the judicial branch's effort to fully override the legislative and executive branches. 15 district judges effectively seized control of various executive branch duties in the first six weeks of the current presidency through nationwide injunctions. This is potentially a judicial coup d'etat. It clearly violates the constitution and more than two hundred years of American history.
To set the stage for this hearing, let me mention 12 former federal judges appointed by president John Adams. Richard Bassett, Egbert Benson, Benjamin Bourne, William Griffith, Samuel Hodge Hitchcock, Philip Barton k, Jeremiah Smith, George Keith Taylor, Oliver Wilcott junior, Williams McClung, Charles McGill and Williams Tillman. President Johnson President Adams app appointed these federal judges on his way out of office to hamstring the incoming president Tom Thomas Jefferson's agenda. President Jefferson concluded that impeaching the judges would take too much time. He and the Congress simply abolished the courts in which they served via the judiciary act of eighteen o two. This is a constitutional balance of power. The legislative and executive branches can reshape the judiciary branch. It is a useful reminder in considering the current situation.
Unelected lower court judges have been steadily grabbing power for years. It was such an obvious threat that in 02/2012, Vince Haley and I wrote, bringing the court back under the constitution. It is an historic study which I am submitting for the record. According to Harvard Law Review, there were 96 nationwide injunctions ordered by district courts from 02/2001 to 02/2023. Two thirds of them, 64, were issued during president's time in office. Furthermore, 92% of the injunctions against president Trump were issued by judges appointed by democratic presidents. Since 01/20/2025, lower courts have imposed 15 nationwide injunctions against the current Trump administration.
This is compared to six during George w Bush's eight years, twelve during Barack Obama's eight years, and 14 during Joe Biden's four year term. The notion that unelected lawyers can micromanage the executive branch and override a commander in chief who receives 77,300,000 votes should trouble every American. This is particularly troubling for issues of national defense and public safety. Around May, Sun Tzu asserted in The Art of War that, quote, speed is the essence of war. How can The United States have speed and national security issues if opponents can judge up to find someone ambitious or arrogant enough to block, repudiate, or delay the president's decisions. There are 677 authorized district judgeships.
How many think they can override duly elected presidents? This summary statement has four propositions. First, the courts have often been challenged. President Jefferson wrote quote, judges as the ultimate arbiters of all constitutional questions would place us under the despotism of an oligarchy. Close quote. President Andrew Jackson was in constant fights with the Supreme Court. President Abraham Lincoln made the Dred Scott decision expanding slavery, a centerpiece of his eighteen fifty eight senatorial campaign. In his first inaugural, president Lincoln warned that if the supreme court held supreme rule, quote, the people will have ceased to be their own rulers, having to that extent practically resigned their government into the hands of that eminent tribunal, close quote.
Second, as the judiciary act of 18 o prove 18 o two proves, the legislative and executive branches can constitutionally defend their rights, and they have in the past. It is historically and constitutionally wrong to think the legislative and executive branches are helpless against judiciary actions. Third, the Supreme Court could intervene to eliminate this attack on the executive branch by district judges. Chief Justice Roberts could end the growing confrontation by establishing a rule that any nationwide injunction issued by a district court against the executive branch would be suspended in implementation and immediately taken up by the supreme court. This would remedy the lengthy appeals process.
Fourth, the Congress and the President can take decisive steps toward bringing the judiciary back into a constitutional framework. This hearing is a good first step. There could be a series of hearings on the constitutional and historic framework, which ensures no single branch of government can acquire dictatorial powers, specifically the judiciary and this committee. These hearings would educate the members and the American people. They would create a national understanding of the need to defend the Constitution against overreaching branches of government. I would also recommend that the congressman that the Congress pass Chairman Issa's No Rulings Act, which is a good signal to the courts that they have gone too far. Ton of information in there. Alright. Ton of information. Now I I'm not necessarily a huge Newt Gingrich fan. I, you know, I I appreciate his his time of service. And and but, you know, I don't agree with him and everything, but he is totally 100% spot on in what he just said. Our founding generation knew what the direction the country would go in if these unelected judges usurp the authority of the elected representatives of the people. In this particular case, the president of The United States. And, and and in in all in truth and honesty, even if it was the other way around, and it was a democratic president, and the republican party was doing this to a democrat, I would still be saying the same thing.
They cannot, should not, and must be stopped doing what it is that they're doing. Now we also had, representative Issa, speaking with, mister Larkin right after, right after, mister Gingrich spoke, and this is very interesting. Also, I want you to hear this too.

Mister Larkin, nationwide injunctions, they're relatively new phenomenon. Right? It's, isn't that correct? Yes. Yeah. It's, it's fair to say nationwide injunctions became, more commonplace '6 in the sixties and seventies. And that is because Congress began authorizing general rulemaking by federal agencies, such as, passage of Clean Air Act or the Clean Water Act?

Well, there there are several factors that led to the late development of it. One is a change in philosophy of what it meant to say that something was unconstitutional. For example, professor Samuel Bray explained this at length in his article. Traditionally, when the court says something was unconstitutional, it meant the government could not enforce it against you. Over time, courts gradually began to to say, no. That means you can't force it against anybody. The problem is that overlooks the role that a district court judge has both horizontally and vertically within the federal system. No one district court judge can bind the appellate court or the Supreme Court. No one district court judge in Maine can bind a district court judge or any judge in Alaska. And so, unfortunately, this practice developed, and we didn't have anybody stepping back and saying, no. Wait a minute. Are there constitutional, statutory, etcetera, limitations on it? And it has actually hurt both parties because each party has suffered through this process.

Speaker Gingrich, as you mentioned in your testimony between 02/2001 '20 '20 '3, there were 96 nationwide injunctions issued, of which 64 granted against were granted against president president Trump. Why do you think the courts have issued nationwide injunctions against president Trump with such frequency? It's it's kind of, a question we're all pondering right now. You know, one of my favorite books on the law is the Bramble Bush,

which is the 1929 introductory lectures at Columbia Law School, and which draws a distinction between the law as it is practiced and the law as it is written. So let's let's just at a common sense level, we be honest. Donald Trump represents a profound, fundamental shaking up of a very deeply resistant establishment, which can be traced back to Franklin Roosevelt in 1933. You take on a system that's almost a hundred years old, the system fights back. The last great bastion of power held by the left is district court judges and their allies on the Supreme Court. And they're behaving as a historian. This is a perfectly natural thing. They're doing everything they can to stop the president who was elected, by millions of Americans. They were elected by no one. But under our system, they have a certain amount of power. Not nearly as much as the modern legal system believes because the 1958 decision by the Supreme Court which said, we are supreme as baloney.
The Supreme Court is supreme in Article three. It is not supreme over the whole constitution. And I think we're now gonna face a genuinely important historic conversation as a country about whether or not unelected judges on a randomized basis who happen to be 92% Democrat have the power to stop the elected commander in chief on item after item after item. My guess is the American people will say to the legislative branch, you gotta be kidding me. And if justice Roberts wants to cut this off, he should act now because this is gonna get worse, not better.

Thank you. Mister Larkin, I'll just, finish up with a quick question about forum shopping. It's something that's clearly been happening, and we're used to it at the state level within the judiciary as well as at the federal level. I was wondering if you had a comment about that. Sure. I mean, the the problem

is attempted to be avoided by having random assignment. But unfortunately, there are some times when there's only a limited number of judges in a particular, district. And as the result, if there's only one, that's who you're gonna get. If there are two, you have a 50% chance. And people wind up doing this, not surprisingly, because they think Judge A is gonna give them a better likelihood of success. Now, you know, that's bad enough when what you're talking about is a damages action because that damages, action is gonna result in a check, perhaps, that goes just to one party. It's different when you're talking about having one judge in any one town enjoying the entirety of the federal government across the nation. That's a much more severe problem, and that's why this is a reasonable effort to cabin that. And, you know, picking favorable judges is the reason why.

I don't think you're gonna find any any more informative discussion than you just did in between those two clips. And I I know they're about, in total about ten minutes, but incredibly important to hear and to understand. Now, you wanna talk about constitutional crises. This has the potential of becoming constitutional crisis. The legislative branch needs to step up. I agree. Totally agree with that. They need to step up. They need to get these judges under control. Again, like like like mister Larkin said, and mister mister Gingrich has said, The Supreme Court is not supreme over the entire constitution, just like a district judge is not a judge for the entire nation.
Now speaker Johnson had said not too long ago, I think it was last week, that, they were gonna be moving on these, on on this issue of these, of these rogue judges, these, activist judges, I should say, not rogue, but these activist judges. He talked about dissolving some of these district courts. You know, and and and to be honest with you, if you read some of the rulings that that these guys come up with, totally unlawful, totally unconstitutional. They read more like they're pitching, an idea for the opinion section of the New York Times or the New Yorker or something like that. A district judge does not have the authority to dictate to the president of The United States issues of national concern.
Within his district, fine, but not at a national level. It needs to be reined in, and it needs to be taken care of, and I I'm you know, we're we're gonna hold the rep the Republican feet to fire. Alright. Let's see. What else got here on the subject? So yesterday, in a in the same committee that we we were just listening to, representative Issa had the opportunity to, you know, basically give a little smack down to to, the, the left's biggest mouth. The left's the Democratic Party's sitting racist. You know who I'm talking about, Jasmine Crockett. I really don't like this woman.
And you know something, you know, Houston, Dallas rather, do better. You could do better than this. You have a representative who is more interested in getting clicks and likes and subs on her TikTok and her Instagram and all that stuff than it is actually serving your district where you live. So yesterday, she decided that she was going to try to scold Republicans for trying to stop the lawfare that the Democratic party has been waging against this administration. Basically sabotaging the administration's agenda. They basically pounced in this feigned anger over Republicans bay because they're not used to Republicans fighting back. That's the problem. Republicans, you know, it it historically, at least within the last fifty years or so, at least in my lifetime. Republicans never really stood their ground on anything. They they always caved, and they always said, yo, we're not gonna be like them. We're not gonna copy what they do. We're not gonna mimic them. We, you know, we're gonna do the right thing. We, you know, by by our standard the right thing. And, so Democrats really aren't used to Republicans pushing back and fighting back.
How dare you? How dare you fight back? So again, their biggest mouth decided that she was going to, give her unhinged opinion on, on on this whole situation during a house judiciary committee meeting, yesterday on Tuesday. Which was which which was about the same thing we were talking about a few moments ago. District court judges blocking, Trump's agenda. And, this is how that went down.

And I'm gonna note that when, miss, Locasio or Cortez or AOC as we know her, filed articles of impeachment, on justice Thomas and Alito, miss Crockett was one of the cosponsor along with mister Cohen, both members of this committee. It does seem interesting that when the shoe is on the other foot, everyone is self righteous, and I think this is a good example. For the last three hours for the last three hours, I have had to listen to one side talking about impeachment as though it was the nature of this hearing. It is not.

So you and you hear her, and he's trying to cut off the chairman. And, but you wanna talk about a smack. I mean, like, ouch. Do you know? Representative Issa, Daryl Issa, California, just letting her know and reminding her of where she stood. And the interesting thing is, you know, she said, you know, how, you know, you have people in in in positions of authority and, you know, talking about, well, just ignore the order. Well, did not Joe Biden do that? Did not the Biden administration ignore lawful orders that were issued by a court? Of course, he did.
Of course, they did. And I'm not saying it's right. Don't don't misunderstand. I'm not saying that, yeah, okay well if they did it we can do it. No, that's not what I'm saying. I'm not saying that at all. It shouldn't happen at all. Because these district judges should not be involved in these particular matters. This really needs to be addressed and addressed quickly because it is it is putting this country on a dangerous path. Somebody referred to them as the Gavel Gestapo. It is pretty good. That's pretty funny actually. I like that. It's it's it's funny. Well, I'm looking at the clock here. It's over an hour and a half. So you know what? I had so many other things that I wanted to get to, but we're gonna hold off on them, for today.
And I'm gonna, you know, we'll talk about some of these things tomorrow, on tomorrow night show. Some I might not because it'll be, you know, not striking while the iron's hot here. But, we'll we'll talk about those, talk about, Chuck Schumer and the Democrats trying to sue Trump to stop him from trying to prevent non citizen from voting. Yeah. You're yeah. You read that you heard that right. Democratic party has filed a lawsuit against president Trump over an executive order designed to maintain integrity in federal elections. Can't make it up.
Can't make this stuff up. So we'll talk about that tomorrow. We'll also talk about, Eric Adams, the mayor of New York City, and we'll talk about some stuff, some disturbing stuff about what's going on over in Ukraine. The FBI will talk about them tomorrow as well. And then we have two stories about something here in Texas that I really wanna get to, because I I feel like I've been neglecting my state here. So I need to, I need to address those things. So we'll we'll do that tomorrow for sure. Absolutely. But, what I do wanna close with tonight is something very sad act well, for me anyway, because I'm a big fan of this particular person, and, you know, I I a lot of the movies that, that that he did came out when I was, you know, in that growing up stage. And, you know, today, it was announced that Val Kilmer, passed away as a result of, complications from pneumonia.
Val Kilmer also he he was 65 when he passed. He had, you know, been through, dealing with cancer. He had throat cancer in 02/2014. He recovered from that, and then, then he came down with with this, pneumonia that, that that he eventually, succumbed to. And, you know, it's it's terrible. It's it's a it's a horrible thing because, again, like, I grew up with this guy, you know, watching his movies. And, I wanna play a clip for you from one of my favorite movies, and, one of my favorite roles that that that he took on. And honestly, I don't think anybody, I I just I I I just can't really picture any after seeing him in this role, I I I can't picture anybody else playing this character, and let me, let me share that with you.

So the Trump administration titled, April 2 as Liberation Day, And it is the day that the administration starts, the reciprocal tariffs. Basically, what he's doing is he's he's forcing other countries that took advantage of The United States One sec. Let me just fix that really quick. Here we go. So of of other countries that took that has taken advantage of The United States for years, years, and years, basically ripping us off. In, in a USA Today op ed, Peter Navarro, who is who's, Trump's, senior senior counsel for trade and manufacturing, said that, tariffs on the auto industry alone would create jobs and increase wages, and he argued that that, it is critical to to national security for The United States to manufacture critical component components like powertrain systems.
He said, quote, powertrain assembly demands deep experience in skilled labor, which is why wages in powertrain facilities are 10 to 20% higher than those in final assembly plants. Today, this, this key pillar of America's once vaunted arsenal of democracy has been hollowed out by decades of unfair trade. No longer does America fully manufacture its its own automobiles. And then here's the here's the gut punch. Fewer than 20% of the engines for vehicles it's, America produces, where where did I get that? America produces fewer than 20% of the engines for the vehicles it it sells. Germany and Japan actually, produce a much a much larger share of the engines and transmissions, that that, that are driving along American roads.
By extending tariffs to this is a quote. By extending tariffs to both autos and auto parts, president Trump is confronting this threat to America's economic and national security. He understands that powertrain design and production are not just technical challenges, they are strategic capabilities. Lose them, and we don't just lose good jobs, we lose industrial strength needed for national defense. And, the markets really did actually reflect. Today, the Dow Jones was up at, as of, this morning. Dow Jones was up, 0.80% at, for an overall of, plus three three seven point eighteen.
The S and P was up 55. The, the, the Nasdaq was up two thirty nine. Russell was up, 29.28. So all of this all of this is having already a positive effect on the American economy, and that's key. That is absolutely key. Like Donald Trump said, it is Liberation Day in America. So at the Rose Garden, the president had a, had a, a presentation, and, he announced his, his his whole display. He he put out the whole display of all of these new tariffs, and, this is, this is where we are, right here. It's gonna be a three minute clip, so I want you to hear this whole thing.

Frankly, it's, very upsetting when you read it, when you see what people have been doing to us for thirty years. This all happened with no response from The United States Of America, none whatsoever. But those days are over. Let me offer just a few examples of the vicious attacks our workers have faced for so many years. The United States charges other countries only a 2.4 tariff on motorcycles. Meanwhile, Thai Thailand and others are charging much higher prices like 60%, India charges 70%, Vietnam charges 75%, and others are even higher than that.
Likewise, until today, The United States has for decades charged a 2.5 tariff. Think of that, 2.5% on foreign made automobiles. The European Union charges us more than 10% tariffs and they have 20% VATs, much much higher. India charges 70% and perhaps worst of all are the non monetary restrictions imposed by South Korea, Japan and very many other nations. As a result of these colossal trade barriers, 81% of the cars in South Korea are made in South Korea. Ninety Four Percent of the cars in Japan are made in Japan. Toyota sells 1,000,000 foreign made automobiles into The United States and General Motors sells almost none.
Ford sells very little. None of our companies are allowed to go into other countries, and I say that friend and foe. And in many cases, the friend is worse than the foe in terms of trade. But such horrendous imbalances have devastated our industrial base and put our national security at risk. I don't blame these other countries at all for this calamity. I blame former presidents and past leaders who weren't doing their job. They let it happen, and they let it happen to an extent that nobody can even believe. That's why effective at midnight, we will impose a 25% tariff on all foreign made automobiles.

So, he also brought out a chart, displaying the tariff rates that he planned to to put on on each nation. Alright. China, which tariffs US goods at a rate of 67%, will face tariffs of 34%. Countries in the European Union, which tariff US goods at a rate of 39% are gonna be tariffed at 20%. Vietnam, a 46% tariff. Taiwan, a 32% tariff. Japan, a 24%. India, twenty six %. And South Korea, a 25%. And and then the chart had like 20 more, countries, listed on there. And, what they also did is they there's like kindergarten, they handed out a fact sheet prior to the announcement that that basically showed, how the administration, was was approaching the tariffs and and and how the administration believes that the tariffs will balance the trade relationships, and and and actually and and bring manufacturing back to America, back on back to The United States on American soil.
Now of course, and that well, as also as you heard him mention in the clip here, you know, the 25% tariffs on automobiles that aren't made in The United States. But but if and you we're already seeing this with, with with Hyundai, with Honda, Nissan, that have committed to bringing manufacturing and production back to The United States, those power those tariffs won't apply. See, the whole idea is to get manufacturing back here into The United States, and, for those that are not going to do anything like that or, you know, it's it's it's applying these what we called reciprocal taxes. Now, I told you earlier to look up what reciprocal is. All that means is, if a country is charging us 10%, we're gonna charge them 10%.
If they charge us 50%, we're gonna charge them 50%. That's reciprocal tax, tariffs. Alright? It's not what the what the mainstream media and, the Democrats are making it out to be. Dollar store Obama, Hakeem Jeffries, of course, criticized the president's tariff plan. And, he told report he told he told, reporters on Wednesday, that, you know, House Republicans, Senate Republicans, and Donald Trump haven't done a single thing to lower the cost of living in the country. Not a single bill, not a single executive order, not a single administrative action. He said, in fact, Republicans are crashing the economy in real time and driving us into recession. This is not a liberation day. It's recession day. And that's what the Trump tariffs are gonna do, crash the economy, he added. But that's not the case at all.
Not the case at all. Just as a stupid example, because of course, you know, you know, egg prices. Everybody's talking about egg prices. Now do you remember, when when when Joe Biden was in office? Nobody seemed to care about the price of eggs in the Democratic side. Right? Nobody said a word about it. The minute that Donald Trump took office, it was, well he didn't bring down the price of eggs, you know, eggs are eggs are really expensive now, and so on and so forth. Eggs, the price of eggs have dramatically dropped. And I forget the percentage. I I know I have it in here somewhere. I'll I'll I'll pull it up for you, but the average price of eggs has decreased.
Gas has decreased. Gas is now, on average below $3 a gallon. That's because we've unleashed American energy. We've unleashed we've opened up to more drilling. We've opened up to more, exploration. We've we've done step by step by step the administration has taken to bring the economy back, to bring the prices down, to bring the cost of living down. And it's not something that's gonna that you you're gonna pick up overnight. It's going to be something that you're gonna it's gonna take time, and we're on the right track. And these tariffs, again, reciprocal tariffs.
What they're charging us, we're charging them. I don't think that that's a that I don't think that's unreasonable. I don't think that that should be something that we should that that anyone should have a problem with. You wanna bring the revenue back into the how do you do it? Not by sending it out, you by bringing it back in. So I think this re these reciprocal tax, tariffs are gonna be a fantastic thing. Let's go to clip number four.

Now just to just to to bring up a point here, in 02/2024, a study was done, that found that that, the tariffs that that the Trump administration put on in his first term strengthened The US economy and led to significant restoring of industries like manufacturing and steel production. And, you know, again, second term, not even a hundred days into the second term, and he's already brought in $5,000,000,000,000 in investments into The US economies by Oracle, SoftBank, Apple, Nvidia, just to name a few of them. So this is this is great news. This is great stuff that's gonna be coming down the road for for America, and I am I'm excited about it, and you should be too. And you should be too. And don't think that that that these other countries, these these other these foreign countries that that have been stopping their feet, and crying and complaining about, about the tariffs, and how they're gonna, you know, increase tariffs on on us, and so on. They're already falling in line. Already falling in line.
For example, Israel. Yesterday, prior to Liberation Day, so a whole day ahead of Liberation Day, Israel announced that it would end all tariffs or customs duties on US imports. The day before, In a joint statement by the prime minister's office, finance ministry, and, and economy and industry ministry said this, quote, at the directive of prime minister Benjamin Netanyahu, finance minister, Bezalel Smotrich, and economy and industry minister Nir Barkat. Israel has canceled all of the customs duties that have been levied until now on products up from The United States, Israel's largest largest trading partner.
The US is Israel's closest ally and most significant trading partner. In 2,024, the export of goods to The US stood at 17,300,000,000.0, while the export of services was estimated at 16,700,000,000.0. The reduction in custom duties will, in effect, expand The US Israel trade agreement and strengthen bilateral strategic relations. The reduction also entails an insurance to Israel Israeli consumers in the form of possible reduction in the cost of living within the anticipated expansion of import and imports of food and agricultural products from The US, which will benefit from a zero customs rate.
So already, even before even before Liberation Day was official, you had Israel canceling all duties, customs, and tariffs on American goods. Mexico has also reduced tariffs already. And, of course, our neighbors up north what the administration likes to call the fifty first state. Also, backing down after the tariff threat came about. Ontario premier Doug Ford on Wednesday suggested that Canada would drop its tariffs on US goods if president Donald Trump eased up on his tariffs on Canadian goods. Let's take a look at, clip five.

No doubt about that. That's I I believe that's what his intention is, and I believe that's where he's going, and that's what he's he's trying to do. And of course, you know, the Democrats are doing everything they can to stop it, you know, through exec through court orders and injunctions, and you name it. He's they're they're trying to do it.
The administration is taking the right steps. They're putting America First. They're putting the American worker first. They're putting the American people first. And this is and and it's it's coming with resounding approval from the American people, from the electorate. This is all good news, this is all good things. Now, of course the left is running around stomping their feet and you know, sucking their thumbs, holding their temper tantrums just like they normally do. Playing the part of the obstructionist, because they don't have anything else. They don't have any, you know, they'll get out, they'll get up there on the, on TV, they'll get up there and they'll stump, they'll make speeches like, which is named Spartacus, Cory Booker. Right? Is it Cory Booker? Yeah. The the guy from the the senator from New Jersey, spent twenty five hours filibustering in the senate. On what? Nothing.
Nothing. He spent twenty five hours talking. Didn't offer any solutions, didn't offer any options or suggestions to, to to to resolve the issues that that that, were of concern to him. Just stood there for twenty five hours just talking, playing the part of the obstructionist. They have nothing to offer. Nothing to offer. Let's see what else. In other news, let's move on to, let's move on to, let me see. How about some Tesla news? Let's do some Tesla stuff. Alright. So, and and just again, as an example of the left, you know, you know, doing everything they can to make everybody's lives miserable because they are the most miserable people on Earth. Democrats, especially the far left liberal Democrats, are the most miserable people you'll ever meet. You know, they're they they claim to be the party of tolerance. They're only but they're only tolerant with people who think the way they do. They don't tolerate anything else. So, that's what you're seeing with all of these, these these Tesla, the the vandalism of all these Tesla vehicles and and the, the destruction of Tesla charging stations, you know, it's it's just obstructionism. It's just they're they're like spoiled children. Alright. Yeah. That's what it is. They're they're they're like spoiled, bratty, rotten children.
What they need is a good spanking, but probably get in trouble for saying something like that. Right? So, Tesla terrorists suddenly face more than just criminal charges. And this is this is a this is a precedent that that's that's it's being laid down right now, and I think it's a I think it's a good thing to do, to be honest with you. I mean, yeah. You know, the the attorney general's talking about, you know, domestic terrorism. That that they're talking about, you know, penalties up to twenty years in jail. You know, in in one recent incident that took place in, in Plano, out here in Texas, Cooper Joe Frederick, is it is, under suspicion for, attacking a Tesla dealership in in Loveland, Colorado.
And, the attorney general, Pam Bondi, you know, she she said this about the prosecution. She said, quote, let this be a warning. You can run, but you cannot hide. Justice is coming. She went on to say, she said, I made it clear that if you take part in the in the wave of domestic terrorism against Tesla properties, we will find you, arrest you, and put you behind bars. All of these cases are a serious threat to public safety, therefore, there will be no negotiation. Now, in addition to that, things are gonna get worse Because now this is taking place.
Fox News reported that, that that, the owner of one of those vandalized Teslas is now suing the suspect for a million dollars in damage. The suspect, Rafael Hernandez, was arrested just a week ago on criminal mischief charge by the Tarrant County District Attorney's Office after he was recorded by the Tesla built in camera striking the left side of the electric powered vehicle. Let's see. In the video, Hernandez could be seen pulling an object out of his pocket and forcing it into the side of the model of the model x. The lawsuit charges individual owners of Tesla vehicles, like like the plaintiff, are being targeted and victimized by ongoing criminal conduct and action.
And the, the report cited that the plaintiff's lawyer explained, whether you're a Republican or Democrat, this is a free country. You're entitled to drive whatever you want. As long as it's legal and within the confines of the law, you should feel safe and secure doing so. The lawyer pointed out the importance of consequences. He said it's a slippery slope. Well, the victim is seeking $1,000,000, and we sat down with his attorney who tells me that he believes that this is the first civil lawsuit that has been filed, in connection to this Tesla takedown movement. His client who wants to stay anonymous, fearing that he is going to be targeted, was returning back from the, trip. He left his car at the Dallas Fort Worth Airport when he saw this. He realized his car had been keyed, so he checked the cameras. That's when he saw the man walk by and vandalize his car. So he posted on x. He wanted to find out who did this. That video quickly went viral. It even caught the attention of Donald Trump junior who posted the video and said, quote, Internet, do your thing. Well, according to the lawsuit, that video helped identify Rafael Hernandez who was arrested and charged with criminal mischief and since posted his bond. The victim's attorney told us, like so many of these victims here, his client just likes the car, and that's why he bought it, and he's apolitical.

Also in Texas right here, police arrested the man seen in this video ramming a mini four wheeler in this bizarre video into a parked Tesla. The car owner told Fox and Friends she lives in fear, worried that someone might target her Tesla while she's inside. And White House officials have labeled these acts as domestic terrorism. That attorney that we sat down with who filed this lawsuit says he hopes this is going to send a really strong message. Not only are you going to face criminal charges, but you could also face these costly

Maybe that's what it'll do. Maybe that's what'll do it. But who knows? Because we are talking about Democrats. We're talking about liberal Democrats. Like I said, maybe half a brain? Maybe? Alright. Well, not only do we deal with domestic terrorists in the in the Democratic party, we also deal with, as I said before, obstructionist. And, you know, I I am a a big fan of Senator Kennedy from Louisiana. I think, he is definitely one of the more, colorful, senators that that we have. Now as you know, I'm and I I I say that because I'm I'm gonna show you a a a wonderful exchange at a confirmation hearing that took place with, Brett Shumate, who's, who's an assistant attorney general nominee, for the, for the administration here. And, it's very interesting because as you know what's going on right now, you have these rogue activist judges that are issuing these nationwide injunctions.
And these aren't, you know, these are these are circuit court judges. These are district district court judges. And as I've said before, and I'll say it again, you know, a judge in in in in Rhode Island should not be able to issue an injunction that affects an issue that's going on anywhere else in the country other than in the in the district or the circuit that he is part of or she is part of. But we see that's that's what's happening. We're seeing all of these nationwide injunctions. We saw it with, this judge Boseberg putting an injunction on the administration for deportation of, of, of the Trendiagua, gang and MS thirteen gang members, to the the the prison in El Salvador, basically demanding that the plane turn around mid flight.
A circuit court judge shouldn't have the ability to do that, to impede the executive branch from doing its constitutionally authorized duties. Now, this subject came up today at a confirmation hearing for, again, Brett Shumate, who's going for, who's being, considered for the, an assistant attorney general. Alright. Now, this is this is kind of a long clip, but I really want you to hear it in its entirety. And I'm gonna I'm gonna I'm gonna wait until it's over, you know, to say anything about it because, first of all, with the the system that I use, I can't pause it. I would have to start all over again if I stop somewhere down the line into it. So, I'm gonna play the whole thing, it's about six minutes, but it's important.
It's very important, you need to hear this, and the line of questioning here. Because these judicial activists are doing everything they can at the behest of their donors, at the behest of the, the Democratic Party, doing everything they possibly can to impede the lawful functions of the executive branch. So let's take a look at, senator Kennedy and Brett Shumate.

Now explain to me how this works. You have a plaintiff and you have a defendant, and the plaintiff files a lawsuit and goes in front of a federal judge. Federal judge has certain jurisdiction and persona and subject matter over the parties, the people, the plaintiff and the defendant. They're the only two people in court. How can a judge, a federal judge, issue an order that affects everybody else other than those in front of him or her? How is that possible?

It shouldn't be possible, senator, but district courts do it all the time. I think on the theory that, the the courts need to enjoin a federal policy from going into effect, and they often will enjoin it as nationwide so all non parties are protected by that injunction.

So why don't the federal judges, instead of issuing a a, a universal injunction with no legal basis, tell the part the plaintiff, look, you gotta go file a class action if you wanna impact parties who aren't subject to my court.

Senator, the Department of Justice makes that argument all the time in our briefs. I think in many cases, class actions would be inappropriate. They wouldn't the the the plaintiffs couldn't satisfy rule 23 to establish a class. So they couldn't? Correct.

So they prefer to to ask for a universal injunction? Yes. K. Does, do do do does this encourage forum shopping?

Not only does it encourage forum shopping, but also district shopping and filing multiple strategic lawsuits to pick find one judge that will enjoin a single policy nationwide where, you know, if you have five lawsuits, a plaintiff one of only one of those five cases needs to be successful.

I think we've the government has cited, cases, from the Supreme Court that says, you know, courts are really bound by the, scope of relief that a court in equity would have granted, back in England before the founding, and the courts at that time would grant relief to the parties in the in the case, not far beyond the You you,

against the Trump administration. Has it not? Yes. And tell me again in my last ten seconds, tell me the basis of article basis for universal injunction in article three. I I read article three, which defines judicial power. Where does it mention universal injunction?

It does not, senator. It says courts are to decide the case or controversy before them, which is based on the parties to the case.

So the Congress could act and say, look, federal judges, you render a decision to a plaintiff or a defendant, but you can't impact people outside of your courtroom other than through a class action. That's why God created class actions, isn't it? Yes, senator. Thank you, mister chairman.

So that that's that's an astounding number. So so 27 injunctions in the twentieth century, 86 injunctions against Donald Trump in his first term, and already, not even eighty days into the second administration, 30. So the question is, should a district judge be able to control all of America? That's a it's that's the quest that's the question of the day. As a matter of fact, there was a, a podcast earlier today, hosted by let's see. It was, representatives Mary Miller, Diana Harshberger Barger, Marjorie Taylor Greene, Mark Alford, and they and they would and Mark Alford, they were discussing, you know, a, like, a slew of actions, on a docket for congressional Republicans, like rolling back the DEI stuff, and, dealing with judges.
Dealing with judges that use their misguided authority and trying to control everything that goes on in the country. That has to be the top priority of this Republican majority, which by the way is too larger now. Now there was a hearing held today on the hill. Daryl Issa, is actually chairing that that hearing. He's also, he's also leading the leading voice on on, on legislation to, to curtail the abuses of the judicial branch. And, he had a couple of high pretty high profile, folks testifying today on the Hill. And, some of the suggestions have been to defund, because that that is under the under the control of the Congress, you know. I mean, the Congress the the the the the circuit, the district courts are not a constitutionally appointed, serve, I I I'm trying to think of the right word.
They're they're not written into the constitution. Like, so in other words, they're they are created by the congress. Alright? And they and congress has oversight of this because congress controls the purse. So congress can and has in the past, which we're gonna hear in just a few moments, totally defund a judicial district. Shut it down completely. Wipe it out. And they can either not have one or they could start a new one. And if they start a new one with the Republican controlled house, they can very easily, of course, nominate and confirm judges that are more in line with the, the Republican party's, agenda.
So on the house today, you had Newt Gingrich, former speaker of the house, Newt Gingrich, questioned today by, representative Issa, and, this is what he had to say.

Thank you, Chairman Issa and Roy, ranking members Johnson and Scanlon, and all the members of the subcommittees for allowing me to testify. There is clearly a potential constitutional crisis involving the judicial branch's effort to fully override the legislative and executive branches. 15 district judges effectively seized control of various executive branch duties in the first six weeks of the current presidency through nationwide injunctions. This is potentially a judicial coup d'etat. It clearly violates the constitution and more than two hundred years of American history.
To set the stage for this hearing, let me mention 12 former federal judges appointed by president John Adams. Richard Bassett, Egbert Benson, Benjamin Bourne, William Griffith, Samuel Hodge Hitchcock, Philip Barton k, Jeremiah Smith, George Keith Taylor, Oliver Wilcott junior, Williams McClung, Charles McGill and Williams Tillman. President Johnson President Adams app appointed these federal judges on his way out of office to hamstring the incoming president Tom Thomas Jefferson's agenda. President Jefferson concluded that impeaching the judges would take too much time. He and the Congress simply abolished the courts in which they served via the judiciary act of eighteen o two. This is a constitutional balance of power. The legislative and executive branches can reshape the judiciary branch. It is a useful reminder in considering the current situation.
Unelected lower court judges have been steadily grabbing power for years. It was such an obvious threat that in 02/2012, Vince Haley and I wrote, bringing the court back under the constitution. It is an historic study which I am submitting for the record. According to Harvard Law Review, there were 96 nationwide injunctions ordered by district courts from 02/2001 to 02/2023. Two thirds of them, 64, were issued during president's time in office. Furthermore, 92% of the injunctions against president Trump were issued by judges appointed by democratic presidents. Since 01/20/2025, lower courts have imposed 15 nationwide injunctions against the current Trump administration.
This is compared to six during George w Bush's eight years, twelve during Barack Obama's eight years, and 14 during Joe Biden's four year term. The notion that unelected lawyers can micromanage the executive branch and override a commander in chief who receives 77,300,000 votes should trouble every American. This is particularly troubling for issues of national defense and public safety. Around May, Sun Tzu asserted in The Art of War that, quote, speed is the essence of war. How can The United States have speed and national security issues if opponents can judge up to find someone ambitious or arrogant enough to block, repudiate, or delay the president's decisions. There are 677 authorized district judgeships.
How many think they can override duly elected presidents? This summary statement has four propositions. First, the courts have often been challenged. President Jefferson wrote quote, judges as the ultimate arbiters of all constitutional questions would place us under the despotism of an oligarchy. Close quote. President Andrew Jackson was in constant fights with the Supreme Court. President Abraham Lincoln made the Dred Scott decision expanding slavery, a centerpiece of his eighteen fifty eight senatorial campaign. In his first inaugural, president Lincoln warned that if the supreme court held supreme rule, quote, the people will have ceased to be their own rulers, having to that extent practically resigned their government into the hands of that eminent tribunal, close quote.
Second, as the judiciary act of 18 o prove 18 o two proves, the legislative and executive branches can constitutionally defend their rights, and they have in the past. It is historically and constitutionally wrong to think the legislative and executive branches are helpless against judiciary actions. Third, the Supreme Court could intervene to eliminate this attack on the executive branch by district judges. Chief Justice Roberts could end the growing confrontation by establishing a rule that any nationwide injunction issued by a district court against the executive branch would be suspended in implementation and immediately taken up by the supreme court. This would remedy the lengthy appeals process.
Fourth, the Congress and the President can take decisive steps toward bringing the judiciary back into a constitutional framework. This hearing is a good first step. There could be a series of hearings on the constitutional and historic framework, which ensures no single branch of government can acquire dictatorial powers, specifically the judiciary and this committee. These hearings would educate the members and the American people. They would create a national understanding of the need to defend the Constitution against overreaching branches of government. I would also recommend that the congressman that the Congress pass Chairman Issa's No Rulings Act, which is a good signal to the courts that they have gone too far. Ton of information in there. Alright. Ton of information. Now I I'm not necessarily a huge Newt Gingrich fan. I, you know, I I appreciate his his time of service. And and but, you know, I don't agree with him and everything, but he is totally 100% spot on in what he just said. Our founding generation knew what the direction the country would go in if these unelected judges usurp the authority of the elected representatives of the people. In this particular case, the president of The United States. And, and and in in all in truth and honesty, even if it was the other way around, and it was a democratic president, and the republican party was doing this to a democrat, I would still be saying the same thing.
They cannot, should not, and must be stopped doing what it is that they're doing. Now we also had, representative Issa, speaking with, mister Larkin right after, right after, mister Gingrich spoke, and this is very interesting. Also, I want you to hear this too.

Mister Larkin, nationwide injunctions, they're relatively new phenomenon. Right? It's, isn't that correct? Yes. Yeah. It's, it's fair to say nationwide injunctions became, more commonplace '6 in the sixties and seventies. And that is because Congress began authorizing general rulemaking by federal agencies, such as, passage of Clean Air Act or the Clean Water Act?

Well, there there are several factors that led to the late development of it. One is a change in philosophy of what it meant to say that something was unconstitutional. For example, professor Samuel Bray explained this at length in his article. Traditionally, when the court says something was unconstitutional, it meant the government could not enforce it against you. Over time, courts gradually began to to say, no. That means you can't force it against anybody. The problem is that overlooks the role that a district court judge has both horizontally and vertically within the federal system. No one district court judge can bind the appellate court or the Supreme Court. No one district court judge in Maine can bind a district court judge or any judge in Alaska. And so, unfortunately, this practice developed, and we didn't have anybody stepping back and saying, no. Wait a minute. Are there constitutional, statutory, etcetera, limitations on it? And it has actually hurt both parties because each party has suffered through this process.

Speaker Gingrich, as you mentioned in your testimony between 02/2001 '20 '20 '3, there were 96 nationwide injunctions issued, of which 64 granted against were granted against president president Trump. Why do you think the courts have issued nationwide injunctions against president Trump with such frequency? It's it's kind of, a question we're all pondering right now. You know, one of my favorite books on the law is the Bramble Bush,

which is the 1929 introductory lectures at Columbia Law School, and which draws a distinction between the law as it is practiced and the law as it is written. So let's let's just at a common sense level, we be honest. Donald Trump represents a profound, fundamental shaking up of a very deeply resistant establishment, which can be traced back to Franklin Roosevelt in 1933. You take on a system that's almost a hundred years old, the system fights back. The last great bastion of power held by the left is district court judges and their allies on the Supreme Court. And they're behaving as a historian. This is a perfectly natural thing. They're doing everything they can to stop the president who was elected, by millions of Americans. They were elected by no one. But under our system, they have a certain amount of power. Not nearly as much as the modern legal system believes because the 1958 decision by the Supreme Court which said, we are supreme as baloney.
The Supreme Court is supreme in Article three. It is not supreme over the whole constitution. And I think we're now gonna face a genuinely important historic conversation as a country about whether or not unelected judges on a randomized basis who happen to be 92% Democrat have the power to stop the elected commander in chief on item after item after item. My guess is the American people will say to the legislative branch, you gotta be kidding me. And if justice Roberts wants to cut this off, he should act now because this is gonna get worse, not better.

Thank you. Mister Larkin, I'll just, finish up with a quick question about forum shopping. It's something that's clearly been happening, and we're used to it at the state level within the judiciary as well as at the federal level. I was wondering if you had a comment about that. Sure. I mean, the the problem

is attempted to be avoided by having random assignment. But unfortunately, there are some times when there's only a limited number of judges in a particular, district. And as the result, if there's only one, that's who you're gonna get. If there are two, you have a 50% chance. And people wind up doing this, not surprisingly, because they think Judge A is gonna give them a better likelihood of success. Now, you know, that's bad enough when what you're talking about is a damages action because that damages, action is gonna result in a check, perhaps, that goes just to one party. It's different when you're talking about having one judge in any one town enjoying the entirety of the federal government across the nation. That's a much more severe problem, and that's why this is a reasonable effort to cabin that. And, you know, picking favorable judges is the reason why.

And I I know they're about, in total about ten minutes, but incredibly important to hear and to understand. Now, you wanna talk about constitutional crises. This has the potential of becoming constitutional crisis. The legislative branch needs to step up. I agree. Totally agree with that. They need to step up. They need to get these judges under control. Again, like like like mister Larkin said, and mister mister Gingrich has said, The Supreme Court is not supreme over the entire constitution, just like a district judge is not a judge for the entire nation.
Now speaker Johnson had said not too long ago, I think it was last week, that, they were gonna be moving on these, on on this issue of these, of these rogue judges, these, activist judges, I should say, not rogue, but these activist judges. He talked about dissolving some of these district courts. You know, and and and to be honest with you, if you read some of the rulings that that these guys come up with, totally unlawful, totally unconstitutional. They read more like they're pitching, an idea for the opinion section of the New York Times or the New Yorker or something like that. A district judge does not have the authority to dictate to the president of The United States issues of national concern.
Within his district, fine, but not at a national level. It needs to be reined in, and it needs to be taken care of, and I I'm you know, we're we're gonna hold the rep the Republican feet to fire. Alright. Let's see. What else got here on the subject? So yesterday, in a in the same committee that we we were just listening to, representative Issa had the opportunity to, you know, basically give a little smack down to to, the, the left's biggest mouth. The left's the Democratic Party's sitting racist. You know who I'm talking about, Jasmine Crockett. I really don't like this woman.
And you know something, you know, Houston, Dallas rather, do better. You could do better than this. You have a representative who is more interested in getting clicks and likes and subs on her TikTok and her Instagram and all that stuff than it is actually serving your district where you live. So yesterday, she decided that she was going to try to scold Republicans for trying to stop the lawfare that the Democratic party has been waging against this administration. Basically sabotaging the administration's agenda. They basically pounced in this feigned anger over Republicans bay because they're not used to Republicans fighting back. That's the problem. Republicans, you know, it it historically, at least within the last fifty years or so, at least in my lifetime. Republicans never really stood their ground on anything. They they always caved, and they always said, yo, we're not gonna be like them. We're not gonna copy what they do. We're not gonna mimic them. We, you know, we're gonna do the right thing. We, you know, by by our standard the right thing. And, so Democrats really aren't used to Republicans pushing back and fighting back.
How dare you? How dare you fight back? So again, their biggest mouth decided that she was going to, give her unhinged opinion on, on on this whole situation during a house judiciary committee meeting, yesterday on Tuesday. Which was which which was about the same thing we were talking about a few moments ago. District court judges blocking, Trump's agenda. And, this is how that went down.

It does seem interesting that when the shoe is on the other foot, everyone is self righteous, and I think this is a good example. For the last three hours for the last three hours, I have had to listen to one side talking about impeachment as though it was the nature of this hearing. It is not.

So you and you hear her, and he's trying to cut off the chairman. And, but you wanna talk about a smack. I mean, like, ouch. Do you know? Representative Issa, Daryl Issa, California, just letting her know and reminding her of where she stood. And the interesting thing is, you know, she said, you know, how, you know, you have people in in in positions of authority and, you know, talking about, well, just ignore the order. Well, did not Joe Biden do that? Did not the Biden administration ignore lawful orders that were issued by a court? Of course, he did.
Of course, they did. And I'm not saying it's right. Don't don't misunderstand. I'm not saying that, yeah, okay well if they did it we can do it. No, that's not what I'm saying. I'm not saying that at all. It shouldn't happen at all. Because these district judges should not be involved in these particular matters. This really needs to be addressed and addressed quickly because it is it is putting this country on a dangerous path. Somebody referred to them as the Gavel Gestapo. It is pretty good. That's pretty funny actually. I like that. It's it's it's funny. Well, I'm looking at the clock here. It's over an hour and a half. So you know what? I had so many other things that I wanted to get to, but we're gonna hold off on them, for today.
And I'm gonna, you know, we'll talk about some of these things tomorrow, on tomorrow night show. Some I might not because it'll be, you know, not striking while the iron's hot here. But, we'll we'll talk about those, talk about, Chuck Schumer and the Democrats trying to sue Trump to stop him from trying to prevent non citizen from voting. Yeah. You're yeah. You read that you heard that right. Democratic party has filed a lawsuit against president Trump over an executive order designed to maintain integrity in federal elections. Can't make it up.
Can't make this stuff up. So we'll talk about that tomorrow. Val Kilmer also he he was 65 when he passed. He had, you know, been through, dealing with cancer. He had throat cancer in 02/2014. He recovered from that, and then, then he came down with with this, pneumonia that, that that he eventually, succumbed to. And, you know, it's it's terrible. It's it's a it's a horrible thing because, again, like, I grew up with this guy, you know, watching his movies.
