It's not that they're banging them. They're just saying send a returner trying to go back and, make up for w twos that were submitted that didn't have a return is what it appears to me. A return attached to it, and they're well, they just keep flooding you with letters, and there's nothing worse than going to the mailbox and getting a letter from the IRS.

So, anyway, it's an interesting weekend, I guess. I don't know that I saw a lot of things. I kinda deviate these days into into distractions, such as football. But, I I got my debit and my credit card reactivated. That's pretty good. I hadn't had either one of them for about two months because of my situation. And I mentioned it last week in the situation I ran into when I opened up an account. I I actually opened up, Paul, the Wells Fargo account from outside the country without signing a signature card. Mhmm. Now let me tell you what. It was not easy.
It it took several months and, just all kinds of hassles, man. Anyway, got it open. So then eventually, they want to send me some cards and stuff, and I said okay. But, when I originally, registered my account, trying to be straight with them. Right? Well, I gave them my Argentina address as my home address, which is alright. They sent me stuff and all that. But, what we didn't understand is that when you go and do credit card charges, the site that you're dealing with does not process the charges. When you hit buy, it automatically moves that over to a processing center. There's a few of those around the world, and they run the charges and everything. Well, if you've got a US based card and a foreign address, they'll kick you out every time. I mean, it got it got so aggravating to me. I was trying to get up here to Ecuador, that I would call the bank and go, look. There's a charge coming in here. Please okay it. And they go, okay. We're looking for it. And it would never come.
And the thing is they see that foreign address in The US issued card, and they just reject it. Period. Caused me a little bit of consternation years ago, so I had to fool around and get a US address. And then they send me that, and my buddies out of the country working and this, that, and the other. And it just, we had to go a couple of weeks after I didn't realize the cards were gonna expire. We only go, I guess, I go four or five years. So, anyway, that happened. Got that straightened out over the weekend. That was quite an obstacle for me. Been a little bit of an impediment here lately.
Like, couldn't go get any funds out of the ATM and things like that. But, anyway, got that over. With the world hadn't blown up because we're still on the air here this morning. But, I can tell you there's a lot of activity in The US. There's a lot of activity in, Portland. It's every night evidently, and there's a lot of activity in Chicago with, Pritzker and the commie. May or not wanting them to not wanting them to be there, period. So I had one ICE car, that they totally surrounded. Paul, did you hear about this? What happened in Chicago?
No. I did not. There was an ICE car somewhere somewhere in Chicago, and all of a sudden on all the the connecting side streets and stuff, all these cars came out and they towed about 10 cars and they blocked the ice car. And then another, wacko with, automatic or semiautomatic machine guns rams the car and gets out. I get I don't know whether he was shooting or not, but kinda like the Old West up there in Chicago now. Pritzker with his arrogant Jew attitude, of course, is continuing to confront Trump and try and stymie him in any way they can. I was gonna backfire on him. I just wish they'd go up there and arrest the son of a bitch. But, yeah, I that arrest him, throw him in jail. Let's see what he does then.
So, anyways, pretty ugly. They're they're proffering that all over the country. Didn't hear any stories about the Memphis situation, and they're in there heavy. And, hopefully, they'll clean up Memphis, and I think he's gonna go into Baltimore and do the same thing. It's inevitable that he, hits Chicago and New York and that stuff again, it would seem. So that's, really starting in the the ramp up to, I guess, civil war number two, what they're trying to institute here. Otherwise, and that's just a quiet weekend for me. Paul, how about you?

You'd like to not be a part of it anymore than, and remove yourself from Jewish Jewish slavery, which is what it is. Under the fourteenth amendment there, you've been frauded and tricked. And if you'd like to get your life straight, get out of that conundrum of crap, and, like like, be like you were supposed to be, then we're here for you. I'm not gonna make you do it. Never told anybody to do it. Go through the process. But, we have, of course, people can chime in. But for those people, that's the show's really for those folks. Now the unfortunate part, the other side, the dialectic is we just don't have too many of those. I I would have thought years ago that, we'll have some information.

I I understand that we're very unique. We've got something really unique here as we listen to, and the whole media landscape changes as the old established monopoly goes into the new Internet. We want news now. We want the truth. And that has just absolutely swamped the, the establishment media. Their numbers are pitiful. Okay? But, so, anyway, they're desperately trying to do something about that so they can sow their evil. And here we and the others are in this alternate space where people are flooding to get real news and truth. And, so here we are.
Now this format platform has developed, and it was because of Paul's knowledge with all the electronics. I wouldn't have known how to set up FCC and run all this stuff and do all these things and have all these other channels. I would never known it would never happen. Period. K? So we're grateful that it did. And then in the process, of course, there's always dialectics. So on the wonderful attributes of this that we can get all these people on here that I put myself out here, with with our findings from our program every day for well, not every day, but almost every day for fifteen years. Never had anybody, find any of the facts that I put out to be wrong.
But, we we've got all this wonderful, truth, transparency, and numbers, but we've got a negative on the other side is that we don't have true duplexing. And there's always a little delay here. And we get into very emotional issues that people really care about here, especially because we're the caring people. If we weren't the caring people, we wouldn't be here. Okay? And so that evidently can cause some, consternation with folks, and I don't want it to. Okay? And I don't want any kind of backlashes coming from the situation we're in as opposed to the gratitude of having the platform we've got and be able to discuss from many different viewpoints these very important and pressing issues that we're confronted with these days.
So all I ask is for your consideration for everybody. We've got, like, a beautiful painting here. If you wanted to draw a analogy and all the different colors and the different personalities and everything else, and it makes a beautiful mosaic to me, the orchestrator here. And, I want people to be able, come on here and ask any question they want. I'll be able to answer, I think, most of them, but some of them I can't answer. If I can't answer it, I'll tell you. I'll tell you I don't know. I'm not too, I'm not above that at all. In fact, I want the truth just as bad as you do, maybe worse.

There's a delay. Okay? And so that causes problems and people don't really read that into the situation, understand it. And we get into these passionate discussions on issues that are very important and very important to people's hearts. And we get excited and barge in at two, three people. I try and keep ride herd on as best I can. I'm pretty good at identifying your voices. And then it's, you know, is it a guy first? Who is first? Do we put the woman first?
All this stuff. So we look. We do the best we can, and any any, any distractions take away from us trying to improve it and make it work. And it's a beautiful format. I would have never envisioned. It's just developed. But with my radio background, I can able I'm able to see what we've got and with the talents that so whatever god gave me that I bring to the table here, we're able to put on a radio show six six days a week, and I just love it. It's the center of my life. Okay? I mean, when I'm not with you guys in these two plus hours a day, all I do is think about you. What how can I what comes up? What can we put out better? You You know, all the things that just revolve around the show. So, the smoother it can go, the better we'll all be.
And, and we won't put as much of a confused face to new people. I don't want people coming here in the middle of, like, last Thursday with all that crap that Daryl insisted on shoving up our barracks bag and, have them come into that as for a show. Although, I gotta admit, some people like that Jerry Springer approach. They really do. I know not me. Okay? Yeah. But I'm not either. Springer. No. No. I'm not either. Don't like it. He says, there's never been a court case on National. K? Never. Oh, why not? You think they're gonna bring in a case challenging their authority and exposing their fraud for the judge that's got a pension and everything else depending on it? Glenn told me after they got out of prison that in the middle of the court case in Salt Lake City, the US attorney got up in open court and said, the IRS has received over a 100,000 of those affidavits we signed. Well, there's only 1,200 people who went through the course. Well, there's your patriot community right there. 1,200 turned into a 100,000. Okay? Because they don't wanna pay. Because, you know, we don't generally have two damn nickels to rub together. Because you're always avoiding the IRS and trying to hide and post office box. I can't have a bank account. I gotta do everything with money orders. All that crap. Well, we're that's gone. Okay?
So that's old patriot mythology shit. But if we can get numbers, we can get people pulling them out of this, this tax system. Obviously, they can't do anything about it, and that really scares them because now they're getting exposed really big. So our best deal is to try and enlarge our ranks. That's our best protection. That's our best insurance. In Spanish, it's called Seguro. That's a best insurance we can get is by enlarging our numbers. And the more people that get turned on to this message, the stronger we get. I thought, boy, how typical. I never even looked into it before. I just erased stuff. Well, turns out to be a Jew boy. His name's Oscar Wolf, and, his email address is right there. And so, I answered him back with both addresses. I sent him a teaser on the quotation marks, and then I went over and sent him a real address and said, of course, Wolfe, w o l f e. It's Jew. And, I told him, of course, that Gallup poll had just recently registered them as the most hated country in the world. Yo yo yahoo, number one most hated leader in the world. The Jewish race is probably the most hated race in the world. And I sent him a copy of God's Trump card and told him that he was a piece of human garbage.
Well, he still threw a couple of new, kind of newsletters at me yesterday, I think, just in that typical Jewish attitude. We'll see where it goes on. I ignored the first one and paid it and read it. Second time it happened, oh, I read it. Oh, so that's why.
And here I am on my third one. The first two were a $135. Mom had a $234 one for doing six miles over in a school zone. And I've already sent my notices way back in September 17, they received them. Okay. So as a national, we when you interlock all these agencies and if they docket a court case, then they're stepping outside of their I stepped outside of my jurisdiction by putting them on notice. But, those kind of things, there's also a nice cover letter that we could draft, Victor, on the initial, notification to the attorney general of your state. And then when you're cc ing everyone else, they get a copy of that cover letter on, allegiance for protection, protection for allegiance.
Because you've changed. See? And they've changed, and they don't even understand this. I'd be shocked if any of those people in Washington in the hierarchy knew this. But, you know, we talk about it around here, protection for allegiance, allegiance for protection. Well, that's your underlying formula for jurisdiction. They like to say we don't have any jurisdiction over that. But when you submitted that affidavit, your choice, they can't say no. You switched the protection from the federal government to the state. Well, now they've got a duty to protect you. They probably don't know that. Okay? And you give them total allegiance, and they've got an intrinsic duty to give you protection. So you might rethink your statement that you don't have any jurisdiction here.

We go to the Russian River all down there off the Kenai River, close to Kenai Lake for reds. There's there's about seven different kinds of salmon, but the most prized is called a red salmon or a sockeye salmon. And we'd go there and have to camp and go hike in a mile to the Lower Russian River and catch our limit of three and then pack out 12 reds on a backpack on your back, which is not easy over hills and valleys.
And then we would take a lot of those and freeze them, Victor, and carry them down. We had a friend at Anchor River who had a smokehouse and a guide thing, and we've become very good friends with them. And we'd have those reds, smoked for twenty one days and canned. And we ate off and others can just can can and silvers and everything else, but we ate off of that, off of that smoked red salmon for ten years after we got back to The States. And I wanna tell you those last few cans of that sockeye that had been that had been marinating in its own juices for ten years, it it it just almost sends you to heaven every bite you took. It's just delicious.

Okay. So I was helping a student for, like, two years with with, IRS issues. So the student, filed a ten forty n r to, get a refund on all the withholdings. For that particular year, they became a national. And, and so the IRS was, you know, constantly challenging the student. And one of the things I've noticed is I've helped a lot of students in the in the last two and a half years with IRS issues, and about 50%, you know, they get their refund back with no issues. And, they'll oftentimes, send me a direct message through Telegram and say, hey. I got my I got my refund back. And, and I'll say that's great news. And, so when I first started doing this, I I learned about a student that was that was, get that got her refund back. Her name is Tiffany, and we, we named it the Tiffany Tiffany sticky note method because, she would fill out a ten forty n r. She would not include an o I, and she would just put a sticky note on it, and and she would and another thing she did was she did the opposite of what the instructions say. She would send it to Charlotte.
Charlotte you you send your ten forty n r to Charlotte if you owe a tax. And remember, ten forty n r's are also for foreign nationals. So they if they are completing a ten forty n r and they owe a tax, they would send it to Charlotte. If you if you are getting a refund, then you'd send it to Austin. So she basically did everything the opposite. Didn't include an o I, which according to the ten forty n r instructions, an o I, which stands for other information, that's a required form. And, so she got she got a refund back, and I think she said to me she received five refunds back, her husband, herself, and her son, over the course of two years. So and that was that was about a year and a half ago that I got that update. So, anyway, I took her method, and I kept, building on it. So I had a foundation because I knew nothing about filling out, you know, any ten forty you know, any forms like this, ten forty n r. Of course, we're all familiar with the ten forty, and so at least I had a little bit of a foundation, with with her input.
So I kept building upon that. And through trial and error, I think I've got a pretty good, streamlined process that that most students can use as a template if they wanna if they wanna get their, withholdings back for that particular year, they became a national. I haven't heard a lot of, a lot of luck with students getting back more than that. In other words, going back more than that year they became a national. I did I did hear of one student who sent me a direct message on Telegram, and he told me he got not only did he get back his, his, the the year that he became a national using my method, which was a little bit more updated than the Tiffany sticky note method.
But, he, he went back another year and also received a refund for that year, and then and then he told me he was gonna go for one more year, and I never heard from him. That was about an that was also about a year and a half ago. I never heard from him again, so I I don't know, you know, what the update is there. But, that was the only other time I heard of someone, getting more than two years. So anyway, the student that I've been helping, she's been she this is a couple, and I'm not gonna say their names. I don't have permission to do that. But, the the the husband works, and, and she's she I've been kinda, you know, communicating with her, and they both are nationals. They both understand, you know, the the information that you teach. You know, for the most part, they understand it. And the IRS, you know, they've just been challenging them every every, you know, every every foot of the every yard of the way, every foot of the way. And I don't know what that phrase is. But, anyway, back in 01/06/2025, I helped draft a, a a correspondence to send to the IRS because, like I said, they they kept challenging, the student.
So they sent in a ten forty n r, but they did not send in an o I, and they needed more information. And that's when I started to change things. So, I started to add the ten forty or the o I to the ten forty n r. And so then I figured out how to complete that form so it could be effective. And, so what we did was we we drafted this correspondence, 01/06/2025, and I'm gonna read this. It's it's just a it's just one page, but it might help students like Debbie. I believe Debbie is having some issues with the IRS, and, it might give her some ideas on how to respond to them.
And so one of the things I encourage students to do is to is to come up with a timeline. So what you do is, put down the date and, what correspondence you received or what correspondence you sent, and then, put down, you know, the person's name if there is one on the form. Put that put their name down as far as who sent you a correspondence from the IRS, and then just, you know, list that in sequential order. And, that that will help out a lot, not only for purposes of drafting, you know, correspondence and responding to an IRS, you know, correspondence.
But also in case you have to call them, it kinda puts a timeline, a brief timeline, in your hands so that you can explain to the agent briefly. You wanna keep things brief because they have a job to do too, and they they could get lost in the details, and you could briefly explain things and then tell them what you want. So, anyway, here's the letter. It was it was, it was sent to commissioner Danny Werfel when he was the, the commissioner, and I always encourage students to send it. At the very least, you wanna send it certified, but important documents like this, you you may wanna send it, USPS priority mail express tracking.
So this one here is legal the title is legal and lawful notice in response to Danny Werfel and Austin's David r Petru failing to recognize and or ignoring my political status as a national slash nonresident alien and unlawfully holding my property. Dear mister Werfel, I would like to draw your attention to a brief timeline of events between me, you, and your Austin office. Number one, on 03/06/2024, you received my legal lawful notice dated 03/04/2024, including a copy of my affidavit of citizenship evidence informing you that I am a national or nonresident alien and not a US citizen. Number two, on 04/15/2024, your Austin office received my 2020, or October tax return dated 04/02/2024 requesting refund.
Number three, several weeks into July, I received a 4087 c letter dated 07/11/2020 '4 requesting tax treaty information upon which my claim for exemption is based. And, again, I don't I don't think this is when we were sending we're I don't I don't think this is when we were including an o I. Anyway, I go on. I faxed, I'm sorry, upon upon which my claim for exemption is based. It was signed by mister Petru, operations manager, ICO. Number four, on 08/06/2024, I faxed my response to the included fax number and I list that, reminding mister Petro that I am not a US citizen or resident, but constitutional taxes. Number five, several weeks passed, so I checked the where is my refund IRS website only to discover, quote, we made changes to your tax return, end quote. That's what was on the correspondence that the student received, and it was now showing a liability.
It also stated that a notice would be mailed out 09/25/2024. Number six, I then received a CP 11 notice from Austin dated 10/10/2024 demanding payment. Number seven, in response to that CP 11 notice, I complete it and filed an amended ten forty NR return dated eleventwentytwenty twenty four, which was received eleventwenty ninetwenty twenty four. This time, I included an OI, other information, showing several tax treaty exemptions based on the laws of The United States Of America and the code of federal regulations. Number eight, and this is the last one in the timeline, on 12/23/2024, I received two notices from the IRS. One date at 12/16/2024 which appears to be ignoring my amended return and one date at 12/23/2024 which appears to be acknowledging my amended return although also denying it at the same time.
I would also like to respectfully remind you as the acting principal of the Internal Revenue Service, you were noticed on March 2024 when you received a copy of my notarized affidavit of citizenship evidence, which currently which is currently on file with the secretary of state of the United States in DC. It was only it was not only timely, it was not timely rebutted by you or the secretary of state and now forever stands as truth, fact, and law. As outlined above and in light of the continuous resistance by David r Petro and his agents to issue my refund and return my property, it appears you have not updated my administrative file to accurately reflect my change in citizenship status.
This may explain why your agents continue to harass me and demand payment for an alleged liability which they say I owe when in fact The United States and the Internal Revenue Service, a bureau of the Department of the Treasury, no longer have jurisdiction over me by inquiring and demanding a tax liability. Please see US versus Slater and as a lot of students know that particular United States Supreme Court case has to do with, unless the defendant can prove he is not a US citizen, the the, the IRS can determine a tax liability. So anyway, it goes on to say my proof of my citizenship or my proof is my affidavit of citizenship evidence, which I respectfully instructed you to permanently and firmly, place in my administrative file. It is a fact I am a private individual.
Going forward, I would greatly appreciate that you please inform your agents of my change of citizenship status to that of a national, which according to 26 CFR 1.1 dash one a is referred to as a nonresident alien individual. Please inform them that I am only responsible for two constitutional taxes, eight seventy one b and eight seventy seven b. Please expeditiously and permanently update my file to accurately reflect these facts. According to the law of nations, I get to choose my political status and what sets set of laws I want to live under. I have chosen to be without The United States by volunteering out of The US federal feudal system as a federal citizen and to live under natural and common law with god given rights and constitutional protections as a national of The United States Of America. Now here's here's where it gets good because the IRS actually did what we instructed them. Within thirty days of receipt of this notice and response, please provide me in writing and or return, refund my property with interest and fees in my favor for unlawfully holding my property for almost two years.
Thank you sincerely, and then the the student signed it, and I always I like writing up under the signature a national and nonresident alien individual inhabiting, and then you could put whatever your state is, and you could put Carol for your address. And I always like to add non domestic without The United States, Twenty Eight United States code paragraph seventeen forty six. And then we sent, copies to Janet Yellen in the form of a CC, Heather m Hill as acting inspector general, for treasure she's the treasury inspector general for tax administration. We also sent a copy to Lauren Skyeirba, acting inspector general for the Department of the Treasury.
Lot of these, offices, may have changed office holders. But, anyway, these were the people that were in those offices at the time. And then lastly, we sent a copy to this. I call them the, the the evil Sith Lord, David R. Petru, operations manager, ICO, department of the treasury, internal revenue service. So, here's what here's what I decided to do. This is my new and improved updated cover letter that I will send with a ten forty n r and an o I, and so here's it's this one's very brief. I've I've I've I've felt like this is a good a good letter to send, and there's a couple of things I'll explain about it. So the title of this is legal lawful notice and instructions in support of the enclosed twenty twenty three ten forty n r filing. And, of course, you you're gonna you're gonna put the, the Austin office's address at the top. You can put the date. You're gonna put the tracking number on it. Dear agent of the IRS, I am a nonresident alien individual. However, I was not engaged in a trader business in The United States, The District Of Columbia during 2024.
I merely want to point out that I am using 26 CFR 1.1 dash one a to show that my income is exempt from US federal income tax according to this, quote, section of the internal revenue code, end quote. I've included page seven of the NR instructions. Please reference one c which I have highlighted for reference and for convenience. And what I do is I encourage the student to take a make a copy of that particular page of the NR instructions, page seven. And it says that, if you look under one c under table a, it says your income is exempt from US tax under a tax treaty, and I like this, or any section of the internal revenue code. And that's why that that that particular code that you often quote, Roger, is very important because that you can make reference of that and and you can show them that, you know, you're the nonresident alien individual in that code, and that's why you're exempt.
So you you just include include a copy of page seven and highlight that section under table a. And then the next paragraph, according to 26 CFR three zero one point six one zero nine dash one parenthesis small g, Since I am no longer a US citizen or resident, please assign the status of nonresident alien individual to my Social Security number in your database. Please reference my affidavit of citizenship evidence that is already on file with the secretary of state of The United States, and that was received by the commissioner and the nonresident alien international department in Philadelphia on such and such date. I instructed the commissioner to place my affidavit permanently and firmly in my file. Now this is very interesting. That particular code that I just referenced, 26 CFR three, 301.6109Dash1 g.
I'm gonna read that to you. It says special rules for taxpayer identifying numbers issued to foreign persons. Number one, general rule, Social Security number. A Social Security number is generally identified in the records and database of the Internal Revenue Service as a number belonging to a US citizen or resident alien individual, a person may establish a different status for the number by providing proof of foreign status, and that's what your affidavit of citizenship evidence is. With the Internal Revenue Service under such procedures as the Internal Revenue Service shall prescribe, including the use of a form as the Internal Revenue Service may specify upon accepting an individual as a nonresident alien individual, the Internal Revenue Service will assign this status to the individual's Social Security number. Now this this the reason I wanna put this in there is because I think I found that why all of these, you know, these these patriot teachers of the past were so adamant about getting out of Social Security. Roger, you've explained many times to the students that having Social Security having a Social Security number or or receiving Social Security benefits or payments, however you wanna word it, is not a nexus to your freedom.
And I think a lot of these, chairs, they they're so adamant about getting out of the Social Security system and not to receive payments from the government, because of this one particular code I found. And that's why I I believe you should reference the the code that I just read. So 26 CFR paragraph three zero one dot seven seven zero one dash eleven. This has to do with the Social Security number. Now listen to this. For purposes of this chapter, the term Social Security number means the taxpayer identifying number of an individual or a state, which is assigned pursuant to section sixty eleven parenthesis small b or corresponding provisions of prior law or pursuant to section sixty one zero nine and in which nine digits are separated by hyphens as follows, and then it gives the format, such term does not include a number with a letter or a suffix which is used to identify an auxiliary beneficiary under the Social Security program.
The terms account number and Social Security number refer to the same number. So anyway, the the very first sentence is what is important. For purposes of this chapter, the term Social Security number means the taxpayer identifying number of an individual, and I think that's why so many past Patriot teachers, wanted you to get out of the Social Security system because there's that connection that it's a taxpayer identifying number. And so what I encourage is to put in your cover sheet 26 CFR three zero one point six one zero nine dash one parenthesis small g so that the IRS can be instructed to convert that number that is generally associated as a taxpayer identifying number as a US citizen, and they can convert it to a nonresident alien, identifying number.
So, also, I think it's prudent to add this this last paragraph to this cover sheet and it and then and this is how it goes. Attention to the agent processing this filing, if you do not understand the information presented here in including but not included to my citizenship status as a as an American national and nonresident alien individual, then please forward this filing to your immediate department manager and or legal department. And then what you wanna do is you wanna list the forms that you're gonna include. You're gonna please you're gonna put, please find enclosed, and you can list completed ten forty n r to get a refund.
Number two, completed schedule o I. Number three, ten forty n r instructions, page seven, and then your w twos and ten four or ten ninety nines, you need to include those also. And here's how you complete the here's how I recommend you complete the o I. So you look at the o I and the the, of course, OI is other information. You wanna make sure you have the the proper year in question, and then you can answer a and b. You could put your identifying number at the top right hand corner. You could put well, you could put your name first and then your identifying number, which is your Social Security number. And then you could under a, it says, of what country or countries were you a citizen or national during the tax year?
This is how I like to, answer this. I was forward slash am a national of The United States Of America, the country. And then under b, it asks, in what country did you claim residence for tax purposes during the tax year? Again, there's that tricky word that you always teach us about, Roger. I put the way I answer this is I do not reside. I am an inhabitant of blank state, smallest state. And so, basically, what you wanna do is you wanna put get a highlighter or a a black Sharpie. And by the way, the IRS likes their forms completed with black ink. So, you know, I know I know, you know, you don't have to strictly abide by that if, you know, because we're not under all their rules and and policies. But, you know, we want this to go smoothly. So just just basically complete all these forms in black ink.
But, you wanna take a a Sharpie or a high a gray highlighter and you wanna go across c because from c to k, none of that information is applicable to us. C is asking, have you ever applied to be a green card holder, lawful permanent resident of The United States? And then it goes on asking a series of questions about, you know, the substantial presence test and there's charts and you gotta put your the dates that that you're in The United States. And and then, you know, it goes on to say, give the number of days including vacation, nonworking days, partial days that you're present in United States. That's h. It goes on down. Are you filing a return for a trust?
Then then you get to k. Did you receive total compensation of 250 or more during the year? You don't have to answer that. It's none of their business. And, so basically, from c to k, you wanna take your highlighter and go across across those lines, the second line of k, and then you could connect it with a diagonal line. And, basically, you're showing the IRS agent that you are kinda x ing off that section. It's not applicable. And then I I suggest you write this to the left side of the of the diagonal line, not applicable, American National, and you could put in parentheses eight United States code paragraph one five zero two and nonresident alien individual per 26 United States code seven seven zero one parenthesis small b parenthesis number one parenthesis capital b.
And that particular code, says this, an individual is a nonresident alien if such individual is neither a citizen of The United States nor a resident of The United States. Okay. So now we come down to section l, and this is very important that you fill this out because this is this is, where you claim your exemptions. So there's a little chart there, and it's on the bottom third of of the OI. It says enter the name of the country, the the applicable tax treaty article, the number of months in prior years you claim the treaty benefit, and the amount of exempt income in the columns below.
Okay. So the country, which is under l, as in my name, Larry, l one, parenthesis, small a, you could put United States Of America. And then what I recommend is under those those columns b and c, you can write Brush Haber versus Union Pacific Railroad Company. Under that, you can write treasury decision twenty three thirteen, and, of course, our our favorite, code 26 CFR on the last line. There's three there's three three lines, 26 CFR 1.1 dash one parenthesis small a. And then what you do is you jump over to to d, which would be l one d, d as in David.
It says amount of exempt income in current tax year. So you're gonna write down what your salary was. Now if you if you work for the federal government, this doesn't apply. This is only applicable if you work for private corporations. And and so you wanna put if if whatever your dub your $10.99 salary is or if if it's a w 2 salary, you wanna put that full amount there, and then you wanna carry it down to the very bottom where the total is.

Okay. So underneath that, you it says, were you subject to a tax in a foreign country or any other or any of the income shown in one d above? You can answer that no. If, number three, this is still under l. It's, there's one, two, and three. One is the chart. Number three is are you claiming treaty benefits pursuant to a competent authority determination? I mean, if you want to, you could say yes, and you can include a copy of the Brush Haber versus Union Pacific Railway, and you can highlight those pertinent sections and even the treasury decision, or and and another thing is you can, also include a copy of 26 CFR.
And so you could put yes, include copies of those documents. You can just maybe include a copy of the of the 26 CFR one that we always quote. So it's up to you what what you wanna do. They I I think they they can go and look these things up. They should be familiar with them, but if you add a copy, that wouldn't hurt either. And then you come to the last section, which is m, and, none of that really applies, so you could just leave that blank. So why is it important to fill out section l one and then a, b, c, and d? Because that's where your exempt income is is is placed because that's what's gonna be carried over to the ten forty n r. So that's my last, piece of paperwork, and I'll show you how to complete this.
So make sure you have the the year that's that's in question as far as what you what you want to get back in the form of a refund. And, you put your name in there, put your Social Security number, you could put your address, and you don't have to do anything fancy here, you know, rural road and all this stuff. Just put your address the way you would normally do it before you became a national. What you could do, and this has been important, foreign country name. You wanna say United States Of America, and then foreign province. You don't have to put anything there, but, I mean, I like putting, you know, the, the your state name, not the state of. You could you could write it like Florida, small S, state, and then forward slash Duval County, Small C for County.
And, I don't I don't think that's really a big issue, but that's just the way I like to do it. And, for and then it says foreign postal code. Just leave that blank because you're gonna I had one student that filled in, like, their code, their their their ZIP code in brackets, and, and that got them, you know, the IRS to respond to them thinking that they're trying to tell the IRS that they're in a foreign country, and so they needed more information. And I said, you shouldn't put anything there. You know? So, anyway, then you come down to filing status. Of course, it's gonna be married filing separately for most people. You don't have to list the dependents.
It's none of their business who your children are and what their Social Security numbers are. And then we come to where you gotta fill in the form with numbers. And so it's very important that you do not put, your your salary on line one a even though it asks for total amount from forms w two box one. And, and and that's because, in the instructions of the ten forty n r, if you're claiming an exemption of your salary, an exemption from federal income tax, you know, for, in terms of your salary, then the instructions tell you to put a zero on line one a and carry over what you put on the o I on l one d, that total, and that needs to come over here to to the $10.40 n r on line one k. That's where your salary goes.
And that that that line is labeled k, total income exempt by a treaty from schedule o I item l line one e. So e was your total amount. So, again, you put zero for one a, and most people are just gonna be putting zeros down for for all of these different categories, you know, like it's asking for your tip income, employer provided adoption benefits, that would be f. Just throwing a couple out here. Number eight, additional income from schedule one. I mean, most people are aren't none of the none of these forms are gonna be applicable to them. So you're just gonna be putting zeros in on all these lines, but, again, what's very important is to put your salary on one k one k.
And, and so, here's here's what it says in the on the NR instructions. Wages, salaries, tips, and other compensation that you claim are exempt from US tax under, under an income tax treaty should not be reported on line one a. Instead, include these amounts on line one k and complete item l of schedule o I form ten forty n r. So then we come to page two of the n r. And, again, more zeros. It it says tax and credits, you know, child tax credit and all this, just bunch of zeros. And then under payments, now this is where you gotta you gotta put some amounts in. So under payments, which is number 25, it says federal income tax withheld from and then you'll see a and b forms w two forms ten ninety nine.
You want to put whatever is applicable on lines 25 a if it's a w two, that's your that's your, your federal income tax that's withheld. So in other words, if you became a national, in a given in a given year, and at the end of the year, you know, they've withheld, you know, $20,000, of of withholdings. You wanna you wanna look on your w two, and you'll see that amount, and then you wanna put that on '25 a. And, of course, if you get ten ninety nines, if you get multiple ten ninety nines, you wanna you wanna find out how much tax you had to prepay because I believe with ten ninety nines, most of the time, you gotta make quarterly payments. So you wanna add all that up and you wanna put that on 25 b, and then you wanna add lines 25 a through 25 c. You wanna put your total amount withheld there.
And then I always put I mean, unless these forms are applicable to your situation, which I don't think with most of our students, they're not going to be, you'll see forms to eighty eight zero five, eighty two eighty eight, that's e, f, and g under payments. I always put NA, not applicable, NA, NA, NA, NA. Now you come down to 32. You wanna put a zero there, and now 32 says ad lines 28, 29, and 31. These are your total other payments and refundable credits. Oh, again, that's that's zero. I'm sorry. 25, 2525, etcetera.
These are your total payments. So now you're gonna put your withholdings down there. Okay? That's what you paid the, the federal government, and then you come down to refund, the refund section. So if line 33 is more than line 24, subtract line 24 from line 33, and, of course, you're gonna be putting down your withholding amount again, and then you come down to 35 a. You could you could read that over. You're gonna put your same withholding amount down on in that particular on that particular line, and then you're gonna, because that's gonna be your refund. And, and then you come down to, the, section where you need to sign and date it, and then you could put in your occupation.
And, you put in your phone number, and you can even put in your email address, and that pretty much, that pretty much concludes the how you complete the ten forty n r. So what happened was with the student I was helping, this was going on now for two I think two and a half years. And after we sent that correspondence, that first correspondence that I read that was dated January 20, January 2025, I encourage the student to go ahead and call the IRS to follow-up. And I I think they received a failure to file or something. And when when the student called up, the the IRS admitted that was a mistake.
And, and so the IRS gave an extension of three months. I believe it was three months. And, for them to process this filing and to look over all the all of this information, which which the student reminded them that that she sent. And, and so then it was through another follow-up phone call several several weeks, maybe a month or two later. She talked with an agent, and they said, oh, yeah. We got it now, and we're gonna be processing your your, your filing for a refund. You should expect to get a refund check, in about four weeks.
Well, lo and behold, the student got up the one morning, and she immediately, texted me on on Telegram and said, you're not gonna believe this, but they put the full amount in in my account. They did a direct deposit even though on the phone, I think they said that they were gonna send a paper check because the on the October n r, you could put in your your, account number and all that. So they ended up, sending it direct deposit. And to top it off and for good measure, they actually did what we requested in that correspondence. We were demanding, interest and fees for for the IRS holding on to to, the withholdings for two years as we went back and forth being what you call, Roger, the belligerent the belligerent claimant.
Just gotta be persistent. You gotta be kind. Treat treat people with respect. You know? Brent always says to honor all men. These are just people trying to do their jobs. They don't know anything, and it's always a good idea. You know, this look at it as an opportunity. Whenever you call in the IRS, you have an opportunity to educate your fellow brother, your fellow man, about how they could be free too. Because as you're explaining this stuff about what your status is, they're gonna they're gonna start, you know, maybe the lights will start going off in their head, and that's how we can make change. But, anyway, they the IRS refunded the full amount, which was a significant amount plus $797 interest in fees.
