I'm Fulton Lewis in the mutual broadcasting system studios in Washington DC now my commentary There were a lot of new developments on the impeachment and White House Watergate tapes fronts today. First and perhaps foremost, the House Judiciary Committee notified the president today that it might consider his refusal to supply subpoenaed Watergate evidence, an indication that the material is damaging to his position also on the committee's agenda was consideration of issuing subpoenas for still more material for its impeachment inquiry in its letter to the president the committee also warned that his refusal to obey its subpoena could be taken as a ground for impeachment.
The letter approved by a 28 to 10 vote called the president's refusal a grave matter. It then said, quote, in meeting their constitutional responsibility, committee members will be free to consider whether your refusals warrant the drawing of adverse inferences concerning the substance of the materials, and whether your refusals in and of themselves might constitute a ground for impeachment. After that committee vote, White House press secretary Ron Ziegler said that the committee's contention is not a valid inference. He added, a vote on impeachment should not be based on an inference. It should be based on a complete assessment of the information before the committee. The committee meeting in open session the day after it completed the first phase of its impeachment inquiry rejected proposals for a harsher response and also to get a court ruling on the controversy.
Alabama democrat representative Walter Flowers called the letter a reasonable response to what I feel is an unreasonable response by the White House. Illinois republican representative Robert McClory said that in subpoenaing tapes of Watergate conversations, the committee acted only out of duty not to strengthen or weaken the office of the presidency he added we acted to expedite the resolution of our inquiry not to delay it we acted ultimately to restore confidence in the office not to destroy confidentiality asked what the practical effect of sending that letter would be John Doerr the chief counsel for the impeachment inquiry said the legal effect of this letter will be to put the president of The United States on notice that the committee has concluded that he has disobeyed its subpoena in a letter to chairman Peter Rodino dated May 22 mister Nixon said that he would not obey committee subpoenas demanding tapes of 11 Watergate conversations and records of presidential appointments over an eight and a half month period.
The president wrote to Rodino, quote, the committee has the full story of Watergate insofar as it relates to presidential knowledge and presidential actions. Production of these additional conversations would merely prolong the inquiry without yielding significant additional evidence. The president said he not only would not produce the subpoenaed material, but that he would reject demands for Watergate evidence that may be called for in such further subpoenas as may hereafter be issued. There was one other development today on the Watergate front, US District Court Judge Sarika refused to allow the house impeachment inquiry to hear portions of four tape recordings for which president Nixon has claimed executive privilege the judge said that he was actually powerless to meet the request of the committee that was made orally on Tuesday in a closed chambers conference the judge last December 19 upheld the privilege claims regarding the four tapes a committee had asked all federal judges with Watergate and related cases to allow it access to materials sealed from public record judge Sarika said that he had honored most of the requests in cases before him after conferring with the White House, the prosecution, and defense attorneys.
The originals of the four tapes involved, two conversations on June twentieth of nineteen seventy two and one each on June 30 and September 15 are all in judge Sarika's private custody. Copies of the tapes minus the portions deemed privileged by the judge went to the grand jury and to the house judiciary committee.
